Terms of Service

These terms are an agreement between you and FintasticApps ("we", "us") covering your use of the Diamonds game and diamondsthegame.com (together, the "Service"). By using the Service you accept these terms. If you do not accept them, please do not use the Service.

1. Who may use Diamonds

You must be at least 13 years old. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian.

2. Your account

• You sign in with Google, and you are responsible for keeping that Google account secure.
• You are responsible for activity that happens under your account.
• One person, one account. Creating accounts to gain an unfair advantage is not allowed.
• Choose a display name that is not offensive, misleading, or impersonating someone else.

3. Fair play

While using the Service, you agree not to:

• Use bots, scripts, automation, or modified clients to play on your behalf
• Exploit bugs instead of reporting them
• Collude with other players to manipulate results or ratings
• Harass, abuse, or threaten other players
• Interfere with, overload, or attempt to gain unauthorised access to our systems
• Reverse engineer the Service, except where that right cannot lawfully be restricted

4. XP and in-game items

XP, ratings, and any other in-game items are a licence to use features inside the game. They are not your property, have no monetary value, and cannot be sold, transferred, or exchanged for real money. We may adjust game balance, including how XP is earned, as the game develops.

5. Our content

The Service, including its code, artwork, and name, belongs to us and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial enjoyment.

6. Availability

We provide the Service as it is at the time you use it. We may change, suspend, or discontinue any part of it, and we do not promise uninterrupted or error-free operation. Scheduled and unscheduled downtime will happen.

7. Suspension and termination

We may suspend or terminate your account if you break these terms or if your conduct harms other players or the Service. You may stop using the Service and delete your account at any time — see Delete your account.

8. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits, arising from your use of the Service. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

10. Changes to these terms

We may update these terms. When we do, we will revise the date above and, for significant changes, tell you in the game. Continuing to use the Service after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of India, and the courts of Bengaluru, Karnataka have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live.
